Business Law Guidance Grounded In Real-World Operations

At The Lively Group dba The Lively Firm, we help business owners make legal decisions that work in the real world, not just on paper. Our attorney, John Jacob "Jacob" Lively, brings together a law degree and former C-suite executive experience, so every matter is evaluated through both a legal and operational lens.

We are a solo business law practice serving privately held businesses, entrepreneurs, and owners who want clear, actionable guidance. Jacob and Gracie Lively are small business owners within The Lively Group, so we approach every issue with firsthand understanding of payroll pressures, growth goals, and day-to-day realities.

If you are facing a business, creditor-debtor, employment, or planning question, contact us at (479) 679-7002 to discuss how we can help you move forward with clarity.

Who We Are

The Lively Group operates as John Jacob Lively, PLLC doing business as The Lively Firm. Jacob Lively is a solo practitioner, business attorney, entrepreneur, and strategic advisor. He earned his law degree from the University of Arkansas School of Law in Fayetteville and now resides and works in Northwest Arkansas.

Before founding The Lively Firm, Jacob served as a former C-suite executive. That background shapes how we approach every engagement. We look at how a decision will affect your operations, people, and cash flow in addition to the legal risks and opportunities involved.

We are licensed to practice in both Texas and Arkansas, and admitted to the Eastern and Western District Courts of Arkansas. This dual-state context allows us to advise on Arkansas business law matters with awareness of neighboring Texas considerations when they arise.

Business-Focused Legal Services

Our reported practice areas are Business, Creditor-Debtor, Labor-Employment, and Wills-Trusts-Probate. Within those categories, we focus on the issues privately held businesses and their owners encounter most often.

Business Law For Privately Held Companies

We work with privately held businesses from formation through growth and transition. Business law matters commonly include business entity formation decisions, contract drafting and review, and ongoing compliance counsel as your company evolves.

Our aim is to align legal structure and contracts with how your business actually operates. We pay attention to governance, decision rights, and risk allocation so you can pursue your strategy with greater confidence.

Creditor-Debtor Matters

For many businesses, managing receivables and obligations is a constant challenge. Creditor-debtor law work often includes collection matters, debtor negotiations, and creditor rights enforcement when necessary.

We evaluate practical options, from structured payment arrangements to more formal collection efforts, always with an eye on preserving value and supporting your overall business objectives where possible.

Labor & Employment Counsel

People decisions carry both legal and cultural implications. Labor-employment counsel for small businesses typically involves employment agreements, independent contractor classification, wage and hour compliance, and termination matters.

We help you understand your obligations and options so you can lead your team confidently, address concerns early, and reduce the risk of avoidable disputes.

Wills, Trusts & Probate For Business Owners

Many business owners look to wills, trusts, and probate planning as part of succession planning and asset organization. Questions about who will own or manage the business, how interests will transfer, and how family members will be provided for often intersect directly with the company.

We work to coordinate your personal planning with your business planning so both support the legacy you want to build, while recognizing that each situation is unique and outcomes can vary.

Why Business Owners Choose The Lively Firm

Clients come to us when they want more than theoretical legal analysis. Jacob applies his executive background to provide advice that keeps business outcomes at the forefront, whether you are negotiating a contract, considering a new hire, or planning for transition.

Because we are a solo practice, you work directly with the attorney handling your matter rather than being passed among multiple associates. This typically means consistent context, a single point of contact, and a relationship built over time.

As small business owners ourselves, we understand that every legal decision exists alongside cash flow, staffing, and growth plans. We aim to explain options in plain language, outline likely scenarios rather than promises, and help you choose a path that fits your risk tolerance and goals.

Our mission is to be a catalyst in our clients' lives and businesses. We strive to create meaningful impact through legal and strategic guidance, whether on a single question or in an ongoing outside general counsel role.

Talk With Us About Your Business

If you are facing a decision about formation, contracts, employment, creditor-debtor issues, or planning for ownership transition, a focused conversation can help clarify your options.

We bring legal training, executive-level business experience, and small business ownership perspective to the table. Our goal is to help you see the road ahead more clearly so you can decide what comes next for your business and your family.

Frequently Asked Questions

What Types Of Clients Does The Lively Firm Serve?

We serve privately held businesses and entrepreneurs, including owners who are building, growing, or transitioning companies. If your legal questions arise from owning or operating a business within our licensed jurisdictions, we are prepared to explore how we can help.

What Does It Mean That You Are Licensed In Both Texas And Arkansas?

Being licensed in both Texas and Arkansas means we can represent clients in legal matters arising under the laws of either state, subject to the specific facts of the matter. We are also admitted to practice in the Eastern and Western District Courts of Arkansas, which can be important when business disputes involve federal claims or cross state lines.

How Do I Get Started Working With You?

A helpful first step is to review our Home page for an overview and our About Us page for more about our approach. When you are ready, you can contact us directly to share a brief description of your situation and discuss next steps.

How Is Working With A Solo Attorney Different From A Large Firm?

With a solo practice like The Lively Firm, you typically work directly with the attorney who will handle your matter from intake through resolution. This can provide more consistent communication and a deeper understanding of your business over time. Larger firms may involve multiple attorneys and staff, which can be beneficial for certain matters, but may also mean more handoffs. We focus on providing thoughtful, business-aware counsel in a streamlined structure.

Our FAQ

Where Business, Retirement & Legacy Meet
  • Do you work with businesses in Arkansas and Texas?
Yes. We assist entrepreneurs, family enterprises, and growing companies across Arkansas and Texas with state-specific regulations, regional transactions, and day-to-day legal operations.
  • How do trademarks help protect my business?
Trademarks help safeguard brand identity (including names, logos, taglines, or product lines) by establishing formal ownership rights in your market. Registering a trademark helps prevent competitors from using confusingly similar branding, supports customer goodwill, and builds brand value over time.
  • What does outside general counsel mean?
Outside general counsel is an arrangement where an external lawyer serves as your ongoing legal advisor on an as-needed basis. This model provides growing companies with routine access to contract reviews, risk management, and operational advice without the expense of a full-time, in-house executive.
